The following Terms & Conditions listed below will apply between you and us (British Birds) for the sale and purchase of the products ordered by you from us. The terms do not affect your statutory rights.

Alternatively you can fax us at the same number. Calls in the UK will be charged at national rate while those from abroad will be charged at rates applicable to where the call is made from.

All rights, including copyright, in the content or material of these British Birds web pages are owned or controlled for these purposes by British Birds. In accessing our web pages, you agree that you may only download a single copy of the content and material for your own individual and non-commercial use. You are not permitted to copy, broadcast, download, store (in any medium), transmit, show or play in public, adapt or change in any way the content of our Birds web pages for any other purpose whatsoever without our prior written permission.

In addition, you may not include a link to our website or display the content or material of our website surrounded or framed or otherwise surrounded by content or material not originating from us without our prior written consent.

By submitting pictures to this website, you warrant that you own the copyright and have the permission (if so required) of the subjects in the picture.

By ordering a product you accept these Terms & Conditions. The Terms & Conditions are subject to change at any time, and it is your responsibility to check these Terms & Conditions regularly before ordering products in case there are any changes. Your continued use of the website constitutes your agreement to be bound by the prevailing Terms & Conditions.

5. Orders

All orders are subject to acceptance and product availability. We (British Birds) aim to ensure that the pricing of products on the web pages is correct at all times; however, the web pages may not accurately reflect the correct details at the actual time you place your order. We cannot confirm the price of a product until your order is accepted on despatch and we reserve the right to change prices without prior notice. You should retain all e-mails relating to the order and contract between us.

To be eligible to enter a contract to purchase through this website you must be over 18 years of age and registered with us by providing the requested information.

6. Your undertakings and warranties

You warrant that the information given on your order form is complete and accurate.

7. Acknowledgement of order

When you have completed your order you will be sent an e-mail confirming your order. It will state the reference number, date, time and total cost of the order. If your order has been unsuccessful, you will be made aware of the reason why and possible explanations by e-mail.

8. Our contract

A legally binding contract between you and us will be formed when we despatch the product(s) to you or when a digital order is completed. This despatch shall represent our legal acceptance of the offer you made to purchase the product(s) when you completed your order. If we advise you that some but not other products that you have ordered have been despatched, those product(s) that have not been despatched will not form part of our contract with you. In the event of any change, e.g. in price or expected delivery date between completion of your order and contract formation, we shall inform you and you shall at that point have the right to either (i) accept such change (in which case your written reply will represent a new offer which we will accept upon notification of despatch) or (ii) reject such change (in which case your e-mail reply will represent a withdrawal of your order, or the relevant part of your order as the case may be). Digital purchases are intended solely for the individual purchasing the product and are non-transferable between individuals. British Birds reserves the right to terminate or interrupt digital services to an individual where these terms are broken.

9. Payment

All credit and charge card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, your order will not be accepted and British Birds will not be liable for any delay or non-delivery.
